A bench of Justices Hima Kohli and Subramonium Prasad ordered the inclusion of Professor S C Rai within the committee, “with the rider that within the occasion of any cleavage in opinion, the casting vote might be exercised by chairperson of committee”.

Justice Kohli requested Datta why, regardless of the one bench order, the panel didn’t operate for 7 days: “Don’t take it amiss. There isn’t a ego battle right here. How are you going to have any curiosity which is opposite to college students?”
Datta stated the exams have been largely successful and there have been “hardly any complaints”. Justice Kohli stated, “If there are hardly any complaints, then why are you involved?… If there are 5 or three members or… members of such a excessive rank as a retired choose, the end result would be the similar.”
Datta stated, “The college have to be allowed to do its job. Can’t we be trusted to care for grievances?” Justice Kohli stated, “Hand sanitisers aren’t the one approach of sanitising the entire place. You’ll be able to sanitise your arms, for sanitising a spot and ensuring the whole lot is on observe, all you want to do was to say… we don’t wish to cover something, we’re open as a guide.”
Datta advised the court docket: “If I’ve not been discharging my obligations in an environment friendly approach, then maybe this could be justified.” Justice Kohli replied, “We’ve got a lot to say about your method of discharging your obligations, trying on the background wherein you may have managed to conduct the OBE. Your readiness has been questioned thrice, you aren’t in a position to fulfill any court docket.”
