Vadodara police on Tuesday booked a person for cruelty to spouse after he allegedly pronounced triple talaq in contravention of the Muslim Ladies (Safety of Rights on Marriage) Act, 2019.
A grievance filed on the Wadi police station in Vadodara states that the complainant, Azima Banu, 25, and Jabeer Hussain Shaikh bought married in 2015. In accordance with Banu, she had a “peaceable” first yr of married life.
“A yr after their marriage ceremony, the complainant discovered that her husband was having an extra-marital relationship. When she confronted him, he admitted that he was planning to marry the girl he beloved. When the complainant refused to offer her consent to her husband’s second marriage, he turned abusive,” mentioned inspector KP Parmar of Wadi police station, citing the grievance.
On July 20, when the couple had a confrontation, the accused uttered the phrase talaq 9 occasions, the grievance mentioned. “Then he requested her to depart stating that their talaq had been formalised as he had uttered it thrice,” Parmar mentioned.
Azima, who works as a home assist, then moved to her mother and father residence in Wadi space. Shaikh has been harassing her and threatening her with bodily hurt, the grievance mentioned.
Shaikh has been booked beneath Indian Penal Code IPC Part 498(A) (cruelty to spouse), 506 (Legal intimidation) in addition to Part three of the amended Muslim Ladies Act, which prescribes three years imprisonment for announcing the triple talaq.
